WELCOME TO TICKETMASTER RESALE
This document, as amended from time to time in accordance with its terms, ("Terms of Use") sets out the terms and conditions that govern use of the Ticketmaster Resale website at resale.ticketmaster.com.au ("Site"). By using or visiting the Site, you expressly agree to be bound by the Terms of Use and to follow the Terms of Use and all applicable laws and regulations governing the Site. Ticketmaster Australasia Pty Ltd ABN 49 089 258 837 and resale.ticketmaster.com.au (collectively "Ticketmaster Resale") reserve the right to change the Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically as Ticketmaster Resale will note when there are updates to the Terms of Use at the bottom of the Terms of Use. Your continued use of the Site will constitute your acceptance of the revised Terms of Use. If you do not agree with the terms of any revised version of the Terms of Use, please do not continue to use the Site. Subject to any rights and remedies that you may have under the Australian Consumer Law, if you violate the Terms of Use, Ticketmaster Resale may terminate your use of the Site, bar you from future use of the Site, remove your ticket listings from the Site, cancel any order for tickets you have made and/or take any other appropriate legal action against you.
PERMITTED USE
You agree that you are only authorised to visit, view and to retain a copy of pages of the Site for your own personal use and that you shall not duplicate, download, publish, modify or otherwise distribute the material on the Site for any purpose other than to review event and promotional information, for personal use or to sell or purchase tickets strictly in accordance with the Buyer Agreement and Seller Agreement (which are available on the Site), unless otherwise specifically authorised by Ticketmaster Resale to do so. You also agree not to deep-link to the Site for any purpose, unless specifically authorised by Ticketmaster Resale to do so. The content and software on the Site is the property of Ticketmaster Resale and/or its suppliers and is protected by Australian and international copyright laws. Ticketmaster Resale may post a legal notice and various credits on pages of the Site which must not be removed. Please do not remove any legal notice or any credits or any additional information contained along with the notices or credits.
BUYER AND SELLER AGREEMENT
Please review the Buyer Agreement, which will govern the purchase of any tickets by you through the Site, and the Seller Agreement, which will govern the sale of any tickets by you through the Site.
Truthfulness and Accuracy of the Information You Provide; Complying with Laws; Verifications and Authorisations
The sale and purchase of tickets to entertainment events is regulated by certain states and cities. You may be asked to provide information during processes you engage in on the Site. You represent and warrant that all information you provide will be true, complete and correct, and that you will update all information as it changes. You also acknowledge that complying with laws is your responsibility, and you agree not to hold us liable for your failure to comply with any law or our failure to notify you of, or properly apply, any law. If Ticketmaster Resale is unable to verify or authenticate any information you provide during any registration, ordering, purchase, ticket listing, sale, authentication, delivery, payment or remittance process, or any other process, or if Ticketmaster Resale is no longer able to verify or authorise your credit or debit card or bank account information, you may be prohibited from using the Site.
USER CONTRIBUTIONS TO THE SITE
From time to time, the Site may provide you with opportunities to contribute to the Site, which may include, but not be limited to, uploading your user profile, participating in chats and using bulletin boards. Anything that is contributed to the Site by you or other Site users will be referred to in the Terms of Use as "User Content". Ticketmaster Resale is not liable or responsible for any User Content. The contributions of third parties do not necessarily represent the view or opinions of Ticketmaster Resale. Ticketmaster Resale cannot preview User Content before it appears. Users can be held liable for any illegal or prohibited User Content they provide to the Site, including, among other things, infringing, defamatory or offensive materials. If you discover this kind of material on the Site, please notify us at resale.service@ticketmaster.com.au and Ticketmaster Resale will investigate your claim and may then take the actions deemed appropriate.
LINKS AND SEARCH RESULTS
The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. Ticketmaster Resale has no control over these sites or the content within them. Ticketmaster Resale cannot guarantee, represent or warrant that the content contained in these sites is accurate, legal and/or inoffensive. Ticketmaster Resale does not endorse the content of any third party site, nor do Ticketmaster Resale warrant that the site will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Ticketmaster Resale for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, please notify us at resale.service@ticketmaster.com.au and Ticketmaster Resale will investigate your claim and take any actions Ticketmaster Resale deems appropriate in our sole discretion.
PROHIBITED CONTENT
The following is a partial list of the kind of User Content which is illegal or prohibited on the Site, being User Content that:
• is patently offensive to the online community, such as User Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
• could be harmful to minors;
• harasses or advocates harassment of another person;
• involves the transmission of "junk mail", "chain letters" or unsolicited mass mailing or "spamming";
• promotes information that is known to be false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
• promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices or providing pirated music or links to pirated music files;
• contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
• displays pornographic or sexually explicit material of any kind;
• provides material that exploits people under the age of 18 in a sexual or violent manner or solicits personal information from anyone under 18;
• provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy or providing or creating computer viruses;
• solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
• is the carrying out, or promotion, of commercial activities without our prior written consent, such as contests, sweepstakes, barter, advertising and pyramid schemes.
OFFLINE CONDUCT
Although Ticketmaster Resale cannot monitor the conduct of users off the Site, it is also a violation of the Terms of Use to use any information obtained from the Site in order to harass, abuse or harm another person, or in order to contact, advertise to, solicit or sell to any Site user without their prior explicit consent.
COMMERCIAL USE
No bulletin board, chat or other areas of the Site may be used by you for any commercial purposes such as to conduct sales of tickets, merchandise or services of any kind, except for the “Buy tickets” and the “Sell tickets” areas of the Site which may be used to buy and sell tickets strictly in accordance with the Buyer Agreement and Seller Agreement. You must obtain our prior written consent to make commercial offers of any kind (other than the offer to sell tickets strictly in accordance with the Seller Agreement), whether by advertising, solicitations, links or any other form of communication. Without limiting the foregoing, you must not use the Site to link to other sites for the purpose of selling tickets of any kind. Ticketmaster Resale reserve the right to block access to the Site or Ticketmaster Resale's other services, remove any ticket listing on the Site or cancel a ticket order made through the Site with respect to any person believed to be, or believed to be acting in concert with any person who is believed to be, violating the law or the Terms of Use or Ticketmaster Resale's rights or utilising automated means to process or place ticket orders. Violating any limitations or terms on the Site will be deemed to be a violation of the Terms of Use.
ACCESS AND INTERFERENCE
You agree that you will not use any robot, spider or other automatic device, process or means to access the Site. Nor shall you use any manual process to monitor or copy pages of the Site or the content contained thereon or for any other unauthorised purpose without our prior expressed written permission. You agree that you will not use any device, software or routine that interferes with the proper working of the Site nor shall you attempt to interfere with the proper working of the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not access, reload or "refresh" transactional event or ticket listing pages, or make any other request to transactional servers, more than once during any three second interval. You agree that you will not copy, reproduce, alter, modify, create derivative works or publicly display any content (except for your own personal, non-commercial use) from the Site without the prior expressed written permission of Ticketmaster Resale.
UNAUTHORIZED USE OF THE SITE
Any illegal or unauthorised use of the Site shall constitute a violation of the Terms of Use. You do not have permission to access the Site in any way that violates, or in the course of violating, the Terms of Use. Illegal or unauthorised use of the Site includes, but is not limited to, using the site to facilitate illegal ticket sales, unauthorised framing of or linking to the Site or unauthorised use of any robot, spider or other automated process on the Site. It shall also be a violation of the Terms of Use for any individual (or group of individuals acting in concert) to request more than 1000 pages of the Site in any twenty-four hour period (hereafter referred to as "Abusive Use").
SUSPECTED VIOLATION OF THE TERMS OF USE OR LAW; EQUITABLE RELEIF, AND LIQUIDATED DAMAGES
Violations of the Terms of Use, including unauthorised use of the Site, may be investigated and appropriate legal action may be taken by Ticketmaster Resale, including (without limitation) civil, criminal and injunctive redress. Subject to any rights and remedies you may have under the Australian Consumer Law, you acknowledge and agree that in Ticketmaster Resale's sole discretion, and without prior notice, Ticketmaster Resale may terminate your access to the Site, cancel any ticket order you have made, remove your ticket listings, remove any unauthorised User Content or exercise any other remedy available, if Ticketmaster Resale believes that your conduct or the conduct of any person with whom Ticketmaster Resale believes you act in concert, or the User Content you provide, or the sale of any tickets listed by you on the Site, violates or is inconsistent with the Terms of Use or the law, or violates the rights of Ticketmaster Resale, a client of Ticketmaster Resale or another user of the Site. You agree that monetary damages may not provide a sufficient remedy to Ticketmaster Resale for violations of the Terms of Use and you consent to injunctive or other equitable relief for such violations. You agree that Abusive Use of the Site, as defined above, causes damage and harm to Ticketmaster Resale in the form of, among other things, impaired goodwill, lost fees and increased expenses associated with responding to Abusive Use of the Site. Accordingly you agree that liquidated damages are warranted for Abusive Use and if you, or others acting in concert with you, alone or collectively request more than 1000 pages of the Site in any twenty-four hour period, you, and those acting in concert with you, will be jointly and severally liable for liquidated damages in the amount of ten dollars ($10.00) per page request each time that a page request is made after that first 1000 during that twenty-four hour period. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), Ticketmaster Resale is not required to provide any refund to you if it exercises any of its rights or remedies because you have violated the Terms of Use or any of Ticketmaster Resale's rights. For more information about how Ticketmaster Resale handles copyright infringements on the Site, please see our Copyright Policy. Additionally, Ticketmaster Resale reserve the right, in our sole discretion, to modify, suspend or discontinue any part of the Site at any time, with or without notice to you. Ticketmaster Resale also reserve the right, in our sole discretion, to impose limits on certain features and services and to restrict access to any part or to all of the Site without notice to you. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), Ticketmaster Resale shall not be liable to you or any third party for any claim or cause of action arising out of our exercise of the foregoing rights.
COPYRIGHT POLICY
Ticketmaster Resale may terminate the privileges of any user who uses the Site to unlawfully transmit copyrighted material without a license, express consent, valid defence or fair use exemption to do so. In particular, users who submit User Content to the Site, whether articles, images, stories, software or other copyrightable material must ensure that the User Content they upload does not infringe the copyrights or other rights of third parties (including, but not limited, to trademark, trade secret, privacy or publicity rights). After proper notification by the copyright holder or it agent to us, and confirmation through court order or admission by the user that they have used the Site as an instrument of unlawful infringement, Ticketmaster Resale will terminate the infringing users' rights to use and/or access to the Site. Ticketmaster Resale may, also in our sole discretion, decide to terminate a user's rights to use or access the Site prior to that time if Ticketmaster Resale believe that an alleged infringement has occurred.
DISCLAIMERS
Ticketmaster Resale does not promise that the Site will be error-free, uninterrupted or that it will provide specific results from use of the Site or any content, search or link on it. The Site and its content are delivered on an “as is” and “as-available” basis. Ticketmaster Resale cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), Ticketmaster Resale disclaims all warranties, express or implied, including also any implied warranties or merchantability and fitness for a particular purpose.
LIMITATION ON LIABILITY AND INDEMNIFICATION
Nothing in this section (Limitation on Liability) is in anyway intended to exclude or limit, or excludes or limits (i) any liability these Terms of Use, the Buyer Agreement or the Seller Agreement expressly provides that Ticketmaster Resale has to you or (ii) any liability that cannot otherwise be excluded or limited under any law (including, without limitation, any liability that may not be excluded or limited under the provisions of the Competition and Consumer Act 2010 and the Australian Consumer Law set out in Schedule 2 of that Act or in respect of any Consumer Guarantee set out in the Australian Consumer Law).
Save as set out above, Ticketmaster Resale will not be liable to you for any damages of any kind arising from the use of the Site, including (without limitation) direct, indirect, incidental, special, punitive and consequential damages or for lost profits, revenues or business opportunities or loss of enjoyment or opportunity, even if Ticketmaster Resale has been advised of the possibility of such damages. Ticketmaster Resale disclaims any and all liability for the acts, omissions and conduct of any third party users, Ticketmaster Resale users, advertisers and/or sponsors on the Site, in connection with the Ticketmaster Resale service or otherwise related to your use of the Site and/or the Ticketmaster Resale services. Ticketmaster Resale is not responsible for the products, services, actions or failure to act of any venue, performer, promoter, producer or other third party in connection with or referenced on the Site.
Without limiting the foregoing, you may report the misconduct of users and/or third party advertisers, service and/or product providers referenced on or included in the Site to Ticketmaster Resale at resale.service@ticketmaster.com.au. Ticketmaster Resale may investigate the claim and take appropriate action, in its sole discretion.
You agree to indemnify and hold Ticketmaster Resale and its affiliates, and each of Ticketmaster Resale's and its affiliates' respective officers, agents, employees, contractors and principals, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.

This Policy explains what personal information Ticketmaster and its group (known in this Policy as “we” or “Ticketmaster”) collect both online (including through apps) and offline and how we use it. Please read it carefully.

As an authorised ticket agent, Ticketmaster sells tickets on behalf of third parties who provide or sponsor an event, or who operate a venue where we hold events. We refer to these artists, agents, venues, promoters or sponsors from whom we obtain tickets to sell to you as our "Event Partners". The Ticketmaster Resale business is an online open marketplace providing a secure platform to buy and sell live entertainment tickets. Ticketmaster is a data controller (i.e. a person responsible for the processing of your personal information) in respect of all of the information which Ticketmaster collects and receives about you when you use our services.

INFORMATION WE MAY HOLD ABOUT YOU
We use the following information for the purposes described in this Policy:
Your contact and account information. We will hold contact information you provide to us (e.g. name, address, phone number, email, country of residence, preferred language) when you create a Ticketmaster account, buy or sell tickets and/or participate in our competitions or promotions.
Your payment and billing information. We will hold payment and billing information you provide to us, e.g. credit card number and post code when you buy a ticket, in connection with the handling of your ticket orders. If you’ve asked us to, we may also store payment and billing information to make it easier for you to buy or sell tickets in future.
Information you post online. For example, we hold information you post on our website or on a third-party social media site to which we have access (including reviews you post or surveys you complete). When you post information online, you must not infringe the rights of others (including privacy rights) and you should be aware that others may use, tag and/or re-publish your information in ways that you might not expect (including in ways that are unlawful). You understand that we and others (including our Event Partners) may use and re-publish any data you post online publicly, on our website or when using apps or social media tools.
Information on your preferences. We may collect information about events you like or products you buy or enquire about (e.g. as part of a survey or from your review of an event). We may also hold information on interests and demographic categories inferred from your interactions with us in order to provide you a better service and to provide you with more focused information. For example, if you buy tickets to a certain show and lots of people who went to that show also bought tickets for a different concert, we might send you information about that concert.
Information from other companies. We will hold information (e.g. your interests, purchases and household type) provided to us by other companies. We may also add information to your details which we have obtained from other companies or sources. For example, we may cross check the accuracy of the information we hold with other databases, or we may add demographic information. Much of this data is created using publicly available sources such as the edited electoral register or a publically available postal address list, or is derived from market research such as consumer panel surveys.
Website usage information. If you use our websites, we may collect information about the browser you're using and your IP address (this is a number that identifies a specific network device on the internet and is required for your device to communicate with websites). We might look at what site you came from, what you did and didn’t use our site for, or what site you visit when you leave us.
App(s) usage information. If you use our app(s), we may collect your GPS location or your device's unique identifier. We might also collect the type of device you are using, or the version of the operating system your computer or device is running. We might look at, for example, how often you use the app and where you downloaded it. Where you allow us to we may also scan your music library when you download our app(s) so that we may send you information about events you may be interested in your area. Email response information. In relation to emails we send you, we may collect information on how you respond to such emails, for example, the number of times the email is opened or the links in them are clicked. Please see our Cookies Policy for more information.
Other information about your interactions with us. For example, if you interact with us via a box office, email, telephone or social media (e.g. Facebook).
xWE MAY USE YOUR INFORMATION IN THE FOLLOWING WAYS AND FOR THE FOLLOWING PURPOSES
To provide you with products, services, account information and support. For example, we might use your information to confirm your registration for an event. If you give us your friend's information, we will use it to provide services you request from us. Before you give us a friend’s information, please do make sure that you have your friend’s permission to share that information with us.
To send you communications in connection with your transaction and events you attend. For example, we might send you emails about your Ticketmaster account or a ticket purchase or ask you if you would like to review an event you attended. We might also contact you about this Policy or any of our other policies or terms.
To identify trends and interests. We use your information to get to know what your preferences might be so we can improve our offering to you and so that your experience with us is more relevant and personal. We may combine information we get from you with information about you we get from third parties, including to analyse customer behaviour.
To monitor and improve our products, services, and websites. We analyse your information to improve our understanding of you and our customer base in general. We do this so that we can make better decisions about our services, advertising, products and content, based on a more informed picture of how our customers use our current services, and to provide you with a more customised experience.
To prevent or detect unlawful behaviour or to protect or enforce legal rights. For example, we may use your information to prevent the reselling of stolen or counterfeit tickets, misuse of our intellectual property (e.g. our or our Event Partner’s brands), or fraud (including credit card fraud and fraud we think has happened during a sweepstakes or promotion or at an event) or other crimes.
For security purposes. We may use your information to protect the security of our company, employees, our customers, third parties and/or our/their property (including any events you may attend and our websites) as permitted by law.
For market research purposes. We may contact you as part of market research we are carrying out. You may choose not to participate.
To provide you with tailored advertising and online behavioural advertising. We may work with other companies to show you advertisements we think you may find relevant and useful. This may include advertisements displayed on our own websites or apps, or advertisements from us displayed on other companies’ sites. The advertisements you see may be based on information collected by us or third parties and/or may be based on your activities on our websites or third party sites. For marketing purposes. Where you’ve agreed, you may be contacted by us by email, text message, telephone or other means with information or offers regarding our upcoming events, products or services (including newsletters). We may also send you information or offers on behalf of other businesses, but when we do this, we do not give those businesses your name and address. Where you’ve agreed to receiving information directly from selected third parties these parties may include charities and retail companies for example, companies offering financial, health, leisure or subscription services.
As otherwise permitted by law. In limited circumstances, we may also use your information for other purposes where permitted by law.
YOU HAVE CERTAIN CHOICES ABOUT HOW WE USE YOUR INFORMATION
When you create a Ticketmaster account, buy or sell tickets or download our apps, we may ask for your consent in order to collect, process or use your personal information for specified purposes.
If you wish to withdraw any consent you have provided to us for such use of your personal information, please write to us or tell us about your preferences using the methods described in this section.
You understand that if you choose not to give us consents, or if you withdraw consents, you may not be able to take advantage of one or more features we offer.

You can opt out of receiving marketing communications. To stop receiving Ticketmaster promotional emails or text messages, you can change your preferences within your account or follow the instructions in any promotional message you get. To stop receiving Ticketmaster Resale promotional messages follow the instructions in any message you get.
Your device settings should provide you with instructions on how to turn off push notifications. It may take about ten days to process your request. Don't worry! Even if you opt out of getting marketing messages, we will still be sure to send you transactional messages. For example, we may still contact you about your orders.
You can opt out of receiving our newsletters. To stop receiving our Ticketmaster newsletters you can change your preferences within your account or follow the instructions in any newsletter you get from us. To stop receiving Ticketmaster Resale newsletters follow the instructions in the newsletter.

WE MAY SHARE YOUR INFORMATION WITH THE FOLLOWING THIRD PARTIES
Within the Ticketmaster family of companies. We may share any or all of your information with our group companies for any of the purposes referred to in this Policy.
Our Event Partners. We will share any of your information with our Event Partners so that they can run the event for which tickets have been purchased, analyse customer behaviour, provide a better service and support to customers, and for any other purpose described in our Event Partners’ privacy policies (including marketing). You should read those policies to learn how they treat your information. From time to time Ticketmaster Resale may list tickets for sale on behalf of (or as agent for) an Event Partner, including, without limitation, “platinum” seats. If you buy these tickets, your personal information will be shared with the Event Partner as described above.
Selected third parties. If you consented to be contacted by email or other means by selected third parties, we may provide your information to the third parties we select, and these third parties may use this information for their marketing or advertising purposes.
Our third party service providers. We may share your information with third parties so that they can provide services to us (e.g. a mailing house, a courier, a call centre provider, or a market research company), but where we do we will put in place a written agreement protecting your information.
Third parties who provide goods and services purchased by you. Your information may also be shared with relevant third parties offering goods and services you have purchased through our website (e.g. ticket insurance or merchandise) so that they can process and fulfil your orders (including by contacting you). If you buy tickets via Ticketmaster Resale, we will disclose your name, contact number and address details to sellers so they can fulfil your order.

1. OVERVIEW
1.1 Introduction. This document, as amended from time to time in accordance with its terms, ( “Agreement”) sets out the terms and conditions under which Ticketmaster Australasia Pty Ltd ABN 49 089 258 837 (referred to as "Ticketmaster”, “Ticketmaster Resale”, “Us” or "We" where applicable) provides ticket buyers ("you", "You", “Your” or "Buyer") the opportunity to purchase tickets listed on the Ticketmaster Resale website at resale.ticketmaster.com.au (the "Website") from third party sellers (“Seller” or “Sellers”). By using the Website and purchasing tickets over the Website You expressly agree to be bound by the terms and conditions of the Agreement.
We strongly recommend that You read and understand the Agreement and, in any event, by continuing to use the Website and buy tickets via the Website You will be bound by the terms and conditions of the Agreement.
1.2 Modification. If We decide to amend, alter or otherwise change the terms of the Agreement, We will notify You by posting the revised version of the Agreement on the Website and emailing You at Your registered email address. The revised Agreement will automatically take effect on being posted on the Website and will replace the terms of any previous versions of the Agreement for all new ticket orders initiated on or after the date it is posted. Your continued use of the Website will constitute Your acceptance of the revised Agreement. If you do not agree with the terms of any revised version of the Agreement, please do not continue to use the Website.
1.3 About Us. Ticketmaster Resale is a Ticketmaster Australasia Pty Ltd (ABN 49 089 258 837) business. Ticketmaster Resale can be reached at 1300 651 607 or at resale.ticketmaster.com.au.
Ticketmaster Resale is not a box office or event promoter. Ticketmaster Resale, through the Website, facilitates an open market place through which tickets may be purchased or sold by Buyers and Sellers. We do not take ownership of any tickets listed by Sellers or purchased by You and We are not a party to any contracts that may arise outside of the Agreement between You and any Seller when tickets are sold and purchased via the Website. Prior to placing any order for tickets, You should carefully consider the legal rights and obligations that may arise outside of the Agreement between You and a Seller from the purchase of the relevant tickets and, if in doubt, you should seek further legal advice in respect of these rights and obligations.
Ticketmaster Australasia Pty Ltd, through its “Ticketmaster” business, sells tickets on behalf of third parties who provide or sponsor an event or who operate a venue where events are held (“Event Partners”). Some of the tickets listed for sale on the Website will be tickets that were originally issued by Ticketmaster on behalf of Event Partners (“Ticketmaster Tickets”). As Ticketmaster was the original issuer of such tickets, Ticketmaster Resale is able to provide a streamlined process to Sellers and Buyers in respect of Ticketmaster Tickets which involves the cancellation of the Ticketmaster Ticket and issue of a new ticket to the Buyer.
2. BECOMING A BUYER
2.1 Requirements. To become a Buyer and be entitled to purchase tickets via the Website, you must create a personal account via the Website. To create a personal account, You will need to provide details such as Your real name, contact telephone number, postal address and a valid credit or debit card that We approve and accept. Ticketmaster Resale has absolute discretion to decide if you qualify (or continue to be qualified) as a Buyer. You are responsible for ensuring that the details You provide Us with remain valid and up to date. If the details You have provided to Us are no longer valid or up to date, Ticketmaster Resale may suspend Your account, or terminate the Agreement, in accordance with section 7 (Term, Termination and Suspension) of the Agreement.
2.2 Registered email address and password. To create and access Your personal account on the Website and use the services on the Website, You will need to provide a valid email address and password. You are solely responsible for maintaining the security of Your registered email address and password and for all activity that occurs on Your personal account under Your registered email address and password.
2.3 Reachable. You must be reachable by telephone between the hours of 8.00am and 10.00pm, Melbourne, Victoria time and respond to all Ticketmaster Resale enquiries in a prompt and timely manner. Certain enquiries and disputes will need to be resolved quickly, particularly in the case of upcoming events. If Ticketmaster Resale’s enquiry relates to an order for tickets placed by You, You must respond within 24 hours or by the specified deadline provided by Ticketmaster Resale via telephone voice message, email or post. You must handle the management of Your account in a reasonable and cooperative manner. If any abusive or threatening behaviour is reported, Ticketmaster Resale reserves the right to terminate the Agreement with You with immediate effect and without prior notice.
3. PURCHASING TICKETS
3.1 Selecting tickets. As a Buyer, You review the tickets listed on the Website and, when You find a ticket that You want at a price You want to pay, You click to buy that ticket, enter and confirm your credit or debit card information and confirm the purchase of the ticket. You should carefully read the full listing details for each ticket before clicking to buy the ticket, including (without limitation) section and row details and any restrictions or qualifications such as restricted view, family section, age restrictions, no alcohol permitted or concession. Please ensure that You have read the full listing details and are happy with Your ticket selection prior to confirming Your purchase as, once confirmed, You must proceed with the purchase of that ticket in accordance with the Agreement and You will likely be contractually bound, as between You and the Seller, to purchase that ticket.
As Ticketmaster Resale provides an open market place for the sale and purchase of tickets, there are many different types of Sellers listing tickets on the Website. For the avoidance of doubt, tickets are not sold by Ticketmaster Resale on the Website, they are sold by third parties. While We do not sell tickets on the Website, We may, on occasion, place tickets on the Website on behalf of (or as agent for) third parties such as Event Partners.
3.2 Pricing. Ticket market prices are volatile and can fluctuate and change at any time. Only when You have successfully completed an order for a ticket in accordance with section 3.4 (Payment) is that order concluded at the price displayed on the Website at the time You click to buy that ticket. Ticket prices are often set at a level which exceeds their “original face value". We make every reasonable effort to provide information on a ticket's “original face value" to you on the Website and to ensure that that information is accurate. The price displayed on the Website for a ticket includes both the price for which the Seller is selling each ticket and all applicable Ticketmaster Resale’s fees and charges for the use of this marketplace (including applicable GST) but excludes any applicable delivery fee. While We try to ensure the accuracy of all prices listed on the Website, sometimes technical errors may occur. In the event that a technical error has resulted in an error in the price of tickets You have ordered, We will inform You as soon as possible and, where practicable, give You the option of reconfirming Your order at the correct price (and credit or debit your credit or debit card as applicable) or cancelling Your order. If You choose the option of cancelling Your order after paying the incorrect price for a ticket, then You will receive a full refund from Us for that amount paid (including the cost of delivery). If we are unable to contact You, or it is not practicable to correct the price, You agree that we may cancel the order with our only liability to You being the full refund of the amount You paid for that ticket (including the cost of delivery).
If You believe that a technical error has occurred when placing Your order, please contact us as soon as possible and provide as much information or evidence of the technical error as possible (including screen shots wherever possible).
3.3 GST. Ticket prices displayed on the Website are inclusive of all applicable GST.
3.4 Payment. 100% full payment for a ticket, at the price displayed on the Website for that ticket at the time that You click to buy that ticket, must be received and verified by Us in order to ensure that an order for that ticket has been made at that price. The accepted forms of payment are those credit cards and debit cards specified on the Website from time to time. All payments will be taken in Australian dollars and Your credit or debit card will be expressed to be charged by "Ticketmaster Resale". The purchase of a ticket at the price displayed on the Website for that ticket is only confirmed once the order has been confirmed by You and payment has been received and verified by Us.
3.5 Confirmation. Once You place Your order and Your payment has been received and verified by Us, an order confirmation email will be sent to the email address You have registered to Your personal account. If You do not receive a confirmation email, do not assume that Your order has not gone through; instead please phone us on 1300 651 607 to request another confirmation email. We are not responsible for any internet connection errors experienced while placing an order for tickets. If You have not received an order confirmation email, it is Your responsibility to contact Us to verify Your order before making another order.
Your order confirmation email will include details of the tickets that you have purchased, together with your name and postal address. You must check these details carefully and let Us know of any errors as soon as possible (and in any event within 24 hours after the time the order confirmation email is sent). Please note that failure to provide correct name, email address or postal address details at the time of account creation (or to keep those details up to date after account creation) could lead to failed delivery of ordered tickets. Any failure by You to provide correct name, email address or postal address details (or to keep these details up to date) is at Your own risk and Ticketmaster Resale takes no responsibility, and is not liable, for any failure to receive ordered tickets or to gain access to events to the extent arising from Your failure to provide Ticketmaster Resale with Your current name, email address or postal address details.
While We try to ensure the accuracy of orders, sometimes technical errors may occur. In the event that a technical error has resulted in an incorrect order, We will inform You as soon as possible and, where practicable, give You the option of reconfirming Your order as corrected (and credit or debit your credit or debit card, if applicable) or cancelling Your order. If You choose the option of cancelling Your order after paying for tickets, then You will receive a full refund from Us for the amount paid (including the cost of delivery). If we are unable to contact You or it is not practicable to correct the order, You agree that we may cancel the order with our only liability to You being the full refund of the amount You paid for the tickets (including the cost of delivery).
To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), despite the fact that You have been advised by Ticketmaster Resale, via an order confirmation email or otherwise, that Your order has been confirmed or otherwise processed or accepted, Ticketmaster Resale reserves the right to suspend an order pending additional fraud checks and to terminate any order that has been fraudulently made. Ticketmaster Resale has no liability to You in connection with the termination of any order that You have fraudulently made.
3.6 Changes / Cancellation of Events. IMPORTANT NOTE: events are sometimes rescheduled or cancelled completely. While event dates and times are normally printed on the tickets and are not usually subject to change, it is important that you monitor local media for any information relating to the rescheduling or cancellation of relevant events.
If an event for which You have purchased a ticket via the Website is cancelled and not re-scheduled, then You agree to follow all reasonable directions of Ticketmaster Resale in respect of Your ticket for that event (including, without limitation, returning that ticket to Ticketmaster Resale to facilitate the relevant Seller obtaining a refund from the promoter or producer of the applicable event). Subject to You complying with all reasonable directions of Ticketmaster Resale in respect of a ticket for a cancelled event that is not rescheduled, Ticketmaster Resale will provide You with a full refund of the amount that You paid for that ticket, excluding any amount paid in respect of delivery fees.
To the fullest extent permitted by law (and subject to Your Australian Consumer Law rights and any rights You have in respect of events that are cancelled and not rescheduled), all ticket purchases on the Website are final and no refund or exchanges will be given by Ticketmaster Resale. Please be aware that on occasion an event promoter or producer may at their discretion or owing to production changes opt to make changes to an event and/or tickets (including, without limitation, by providing alternative seats instead of the original seats). If an event promoter or producer reschedules an event, the applicable ticket will often be valid for the new date and time. Unless otherwise required by law, Ticketmaster Resale has no liability to You in respect of changes to an event and/or tickets or rescheduled events, including (without limitation) any liability to refund the price of the applicable ticket (or any delivery fees). In the event that Ticketmaster Resale does contact You in respect of changes to an event and/or tickets or rescheduled events, then You must cooperate with Ticketmaster Resale and (through Ticketmaster Resale) the Seller in respect of those changes or that rescheduling.
Nothing in this section 3.6 is intended to limit, or limits, any rights You may have under the Competition and Consumer Act 2010 (including under the Australian Consumer Law set out in Schedule 2 of that Act) or any other applicable consumer law.
3.7 Queries and Ticket Validity. All queries relating to tickets purchased via the Website must be directed to Ticketmaster Resale at resale.service@ticketmaster.com.au rather than to the relevant venue, promoter or producer. Subject to the applicable ticket, promoter/producer and venue terms and conditions, if a ticket You purchase via the Website does not give You entrance to the applicable event, We will refund 100% of the purchase price You paid for that ticket as part of our Ticketmaster Guarantee. However, if You breach the applicable ticket, promoter/producer or venue terms and conditions (or if You breach the Agreement including, without limitation, by directing any queries relating to the tickets to the venue or promoter/producer rather than Ticketmaster Resale) and as a result are not able to gain entry to the event, then You are not entitled to receive any refund under the Ticketmaster Guarantee.
3.8 Substitutions. Please be aware that a Seller might substitute a ticket that You have ordered via the Website with a different ticket (for example, a ticket that has equal or better seat locations). If You accept tickets delivered to You in substitution for the original tickets that you ordered via the Website, then, irrespective of the differences between the tickets, you irrevocably waive Your right to exercise the Ticketmaster Guarantee in relation to such tickets.
3.9 Seating. Unless indicated otherwise at the time of purchase, all tickets purchased in a single order will be seated together.
4. DELIVERY
4.1 Delivery of Ticketmaster Tickets. (For the definition of a Ticketmaster Ticket, see section 1.3 (About Us).) If You order a Ticketmaster Ticket that is listed for sale on the Website, then the Seller’s ticket will be automatically cancelled by the Ticketmaster ticketing system on the electronic authentication of Your order and payment and Ticketmaster Resale will reissue a new ticket to You. Ticketmaster Resale will email the new ticket to the email address that You have registered to Your personal account. To the fullest extent permitted by law, Ticketmaster Resale’s liability to You in connection with the cancellation of any Ticketmaster Ticket and the reissue of a new ticket is limited to the amount paid by You for that new Ticket (including the cost of delivery).
If You have not received the new ticket issued in replacement of a Ticketmaster Ticket within 24 hours after placing the order for that ticket, You should immediately contact Ticketmaster Resale on 1300 651 607. Please note that, before ordering any tickets on the Website You should ensure that the email address You have registered to Your personal account is up to date. Any failure by You to provide a valid email address at the time of account creation (or to keep Your registered email address details up to date) is at Your own risk and Ticketmaster Resale takes no responsibility, and is not liable, for any failure to receive ordered tickets or to gain access to events to the extent arising from Your failure to provide Ticketmaster Resale with Your valid email address.
The provisions of sections 4.2 to 4.4 below do not apply in respect of Ticketmaster Tickets.
4.2 Delivery Method for tickets other than Ticketmaster Tickets. All tickets ordered via the Website (other than Ticketmaster Tickets) will be dispatched by the Seller using the carrier nominated by Ticketmaster Resale from time to time. Deliveries will need to be signed for and accepted in person. It is Your responsibility to provide an appropriate delivery point and to make yourself available to sign for and accept delivery. Ticketmaster Resale will not be liable for refused or failed delivery to the extent arising from Your failure to provide complete delivery information to Us (including, without limitation, Your real name and correct, up to date, postal address) or for any unclaimed post or return deliveries. If for any reason Your tickets are returned to Us or We are notified that they could not be delivered, We will attempt to contact You and arrange for another delivery via Ticketmaster Resale’s nominated carrier. Please be aware that in these circumstances, You will be liable for the full cost of the redelivery. To the fullest extent permitted by law, Ticketmaster Resale takes no responsibility, and is not liable, for Your failure to receive ordered tickets or to gain access to events to the extent arising from Your failure to provide Ticketmaster Resale with complete delivery information or to be available for, or to otherwise sign for and accept, delivery.
In the event that any ticket ordered by You via the Website is lost, delayed or damaged due to the fault of Ticketmaster Resale’s nominated carrier such that You are unable to use that ticket to attend the relevant event, then Ticketmaster Resale will refund You 100% of the amount You paid for that ticket (including the cost of delivery). If Your tickets have not arrived five working days after You are sent the order confirmation email for those tickets, You must immediately notify Ticketmaster Resale on 1300 651 607 so that we can initiate an investigation. If Ticketmaster Resale notifies You that We are investigating the delivery of any ticket that has been ordered by You, you must fully cooperate with Us in respect of that investigation. Despite any other provision to the contrary in the Agreement, Ticketmaster’s liability to provide a refund to You in respect of any failed delivery of tickets is limited to the extent that Your failure to do something required by the Agreement has contributed to (or limited the rectification of) that failed delivery.
4.3 Local address. Tickets ordered via the Website are only able to be delivered to an Australian postal address.
4.4 Failed delivery. If for any reason Your tickets are returned to Us or could not be delivered and We are unable to contact You to arrange for redelivery or You refuse delivery of Your tickets, then You agree that We may place the tickets back for sale on the Website on consignment and act as your agent to attempt to recover some or all of Your costs. You have the right to set the asking price for Your tickets, however, if no communication can be made with You, we will price them reasonably appropriately in attempt to recover as much of Your money as possible. In some cases this could be substantially less than what You originally paid for the tickets and we cannot guarantee a sale completes at all. If Your tickets do sell, We will first deduct an administration fee of $50 from the sale proceeds, then pay You any available balance of those proceeds up to the amount that You paid for those tickets (including the cost of delivery) and You agree that We may then retain any remaining portion of those proceeds. Ticketmaster Resale has no obligation to place Your tickets on consignment and no obligation to You for the payment of any amount in respect of those tickets other than as expressly set out in this clause 4.4 (Failed delivery) or as otherwise required in accordance with law (including, without limitation, Australian Consumer Law).
4.5 Tickets held back by the promoter or producer. Sometimes a promoter or producer of an event may hold back the distribution of tickets until closer to the time of the event. If a promoter or producer is holding back a ticket that You have purchased from the Website, that ticket will be delivered to You as soon as possible once the promoter or producer releases that ticket.
4.6 Accuracy. Once tickets have been delivered to You, it is Your responsibility to immediately check the tickets for accuracy. If there are any discrepancies between a ticket that You receive and the ticket that You ordered via the Website, You must immediately notify Us and must comply with any reasonable direction given by Us in respect of the incorrect ticket (including, without limitation, the return of the incorrect ticket to Us at Ticketmaster Resale’s cost). If You receive an incorrect ticket, We will endeavour to source a replacement ticket for You that is (in Ticketmaster Resale’s reasonable opinion) equal to or better than the incorrect ticket (“Replacement Ticket”). You acknowledge that We may not be able to, or it may not be practicable for Us to, purchase a Replacement Ticket and, in this case, our liability to You will be limited to the full refund to You of the amount that You paid for that ticket (including the cost of delivery). If You do not return incorrect tickets to Us on request and/or subsequently use such tickets, then You will not in any circumstances be entitled to a refund for those tickets and irrevocably waive Your right to exercise the Ticketmaster Guarantee in relation to such tickets.
If You report a discrepancy between a ticket that You receive and the ticket that You ordered while at the relevant event or after the event is held, you will be deemed to have accepted the delivered tickets as valid and waive Your right to the Ticketmaster Guarantee.
4.7 Lost, stolen, damaged or destroyed tickets. Please treat all tickets that You receive with extreme care as Ticketmaster Resale does not issue an exchange or refund for a lost, stolen, damaged or destroyed ticket unless, in the case of Ticketmaster Tickets only, You give Ticketmaster Resale a reasonable amount of notice ahead of the relevant event that the ticket has been lost, stolen, damaged or destroyed, in which case Ticketmaster Resale may issue a replacement ticket to You for a reasonable administration fee.
5. LIABILITY AND INDEMNIFICATION
Nothing in this section 5 is in anyway intended to exclude or limit, or excludes or limits, any liability that the Agreement expressly provides Ticketmaster Resale has to You or any liability that cannot otherwise be excluded or limited under any law (including, without limitation, any liability that may not be excluded or limited under the provisions of the Competition and Consumer Act 2010 and the Australian Consumer Law set out in Schedule 2 of that Act).
5.1 Release. Ticketmaster Resale, through the Website, facilitates an open market place for the sale and purchase of tickets. Ticketmaster Resale is not a party to any contract that may arise outside of the Agreement between You and any Seller when tickets are sold and purchased via the Website. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), Ticketmaster Resale has no liability to You in connection with any contract between You and a Seller and You release Us from any liability We may have to You in respect of any expenses, costs, losses, damages, claims or demands that You may incur or suffer in connection with any contract between You and a Seller.
5.2 Liability. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), Ticketmaster Resale shall in no circumstances be liable to You for any indirect or consequential losses or any loss of enjoyment or opportunity arising out of Your use of the Website, including (without limitation) from Your purchase of tickets or any failure to purchase tickets. In respect of each order for tickets that You make via the Website, Ticketmaster Resale’s liability to You whether in contract, tort or otherwise shall be limited in aggregate to the total amount paid by You in relation to such order (including the cost of delivery).
5.3 Event Loss. For the avoidance of doubt, Ticketmaster Resale does not stage, and is not responsible for the staging of, the events for which You may purchase tickets on the Website. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), We disclaim all liability connected with the staging of events for which You have purchased tickets from the Website and for any death or personal injury suffered by You, or any person to whom You provide a ticket purchased from the Website, arising out of attendance at, or travel to, any event unless caused by our negligence. Neither shall We be liable for any loss or damage sustained to Your property or belongings (or those of any person to whom You provide a ticket purchased from the Website).
5.4 Force Majeure. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), We will not be liable for any loss or damage suffered by You arising out of circumstances that are beyond our control including but not limited to any act of God, natural disaster, act of terrorism or other force majeure event.
6. WARRANTIES
6.1 True information. You represent and warrant to Us that the information You submit to Us in creating and updating Your personal account and in making an order for tickets on the Website is true, accurate and complete. You agree not to use false names or addresses, or any other false information, in using the Website.
6.2 Legal Compliance. You represent and warrant to Us that, during any interaction with the Website, you will comply with all applicable local, state, national and international laws. You also represent and warrant to Us that you are 18 or over and therefore able to enter into legally binding contracts.
7 TERM, TERMINATION AND SUSPENSION
7.1 Term. Subject to section 7.2 (Termination), the Agreement commences on the date You first create a personal account on the Website and continues in force until the date that falls 30 days after either party receives notice in writing from the other party terminating the Agreement.
7.2 Termination. Either party may terminate the Agreement immediately by giving written notice to the other party if the other party (i) commits a material or persistent breach of its obligations under the Agreement and fails to remedy that breach within 7 days after being given written notice specifying the breach and requiring it to be remedied; or (ii) is unable to pay its debts, becomes insolvent or any action is successfully taken to wind it up or to appoint a liquidator, administrator or controller (as defined in the Corporations Act 2001 (Cth)) or it enters into an arrangement, compromise or composition with or assignment for the benefit of its creditors or any of them or, in the case of an individual, is declared bankrupt.
Ticketmaster Resale may terminate the Agreement immediately if, in its reasonable opinion, You are involved or likely to be involved in any illegal activity.
7.3 Suspension. Without limitation to its other rights under the Agreement or otherwise at law, Ticketmaster Resale may suspend Your account for one calendar month or such longer term as determined by Ticketmaster Resale in its sole discretion, if You breach any of the terms of the Agreement.
7.4 Consequences of termination. Termination of the Agreement does not affect the rights or liabilities of either party accrued prior to and including the date of termination and/or any terms intended expressly or by implication to survive termination.
8. MISCELLANEOUS
(A) The Agreement (and all documents incorporated by reference) constitutes the entire agreement between the parties pertaining to its subject matter and supersedes all prior agreements and understandings between the parties with respect to its subject matter, whether written or oral. No amendment, modification or supplement of any provision of the Agreement will be valid or effective unless made in accordance with the express terms of the Agreement. If any provision of the Agreement is held to be invalid or unenforceable under any circumstances, its application in any other circumstances and the remaining provisions of the Agreement will not be affected.
(B) No failure or delay by either party in exercising any right under the Agreement should be deemed to be a waiver of that right and no waiver of a breach of a provision of the Agreement shall be deemed to be a waiver of any subsequent breach.
(C) You may not assign or transfer the Agreement, or any rights or obligations under the Agreement, without the prior written consent of Ticketmaster Resale, which We can refuse in our absolute discretion.
(D) Nothing in the Agreement is intended to confer benefits, rights or remedies on any person or entity other than the parties to the Agreement and their successors and permitted assigns.
(E) The subject heading at the beginning of each paragraph of the Agreement is for reference purposes only and in no way defines, limits, construes or describes the scope or extent of such paragraph.
(F) Any notices required or permitted to be given under the Agreement must be in writing and sent by registered post addressed (i) if to Ticketmaster Resale, to Level 5, 364 Lonsdale Street, Melbourne Victoria 3000 and (ii) if to You, to the postal address provided by You in creating Your personal account, as updated by You from time to time.
(G) The Agreement shall be governed by and construed in accordance with the law of Victoria, Australia and both parties agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.
1. OVERVIEW
1.1 Introduction. This document, as amended from time to time in accordance with its terms, ( “Agreement”) sets out the terms and conditions under which Ticketmaster Australasia Pty Ltd ABN 49 089 258 837 (referred to as "Ticketmaster”, “Ticketmaster Resale”, “Us” or "We" where applicable) provides ticket buyers ("you", "You", “Your” or "Buyer") the opportunity to purchase tickets listed on the Ticketmaster Resale website at resale.ticketmaster.com.au (the "Website") from third party sellers (“Seller” or “Sellers”). By using the Website and purchasing tickets over the Website You expressly agree to be bound by the terms and conditions of the Agreement.
We strongly recommend that You read and understand the Agreement and, in any event, by continuing to use the Website and buy tickets via the Website You will be bound by the terms and conditions of the Agreement.
1.2 Modification. If We decide to amend, alter or otherwise change the terms of the Agreement, We will notify You by posting the revised version of the Agreement on the Website and emailing You at Your registered email address. The revised Agreement will automatically take effect on being posted on the Website and will replace the terms of any previous versions of the Agreement for all new ticket orders initiated on or after the date it is posted. Your continued use of the Website will constitute Your acceptance of the revised Agreement. If you do not agree with the terms of any revised version of the Agreement, please do not continue to use the Website.
1.3 About Us. Ticketmaster Resale is a Ticketmaster Australasia Pty Ltd (ABN 49 089 258 837) business. Ticketmaster Resale can be reached at 1300 651 607 or at resale.ticketmaster.com.au.
Ticketmaster Resale is not a box office or event promoter. Ticketmaster Resale, through the Website, facilitates an open market place through which tickets may be purchased or sold by Buyers and Sellers. We do not take ownership of any tickets listed by Sellers or purchased by You and We are not a party to any contracts that may arise outside of the Agreement between You and any Seller when tickets are sold and purchased via the Website. Prior to placing any order for tickets, You should carefully consider the legal rights and obligations that may arise outside of the Agreement between You and a Seller from the purchase of the relevant tickets and, if in doubt, you should seek further legal advice in respect of these rights and obligations.
Ticketmaster Australasia Pty Ltd, through its “Ticketmaster” business, sells tickets on behalf of third parties who provide or sponsor an event or who operate a venue where events are held (“Event Partners”). Some of the tickets listed for sale on the Website will be tickets that were originally issued by Ticketmaster on behalf of Event Partners (“Ticketmaster Tickets”). As Ticketmaster was the original issuer of such tickets, Ticketmaster Resale is able to provide a streamlined process to Sellers and Buyers in respect of Ticketmaster Tickets which involves the cancellation of the Ticketmaster Ticket and issue of a new ticket to the Buyer.
2. BECOMING A BUYER
2.1 Requirements. To become a Buyer and be entitled to purchase tickets via the Website, you must create a personal account via the Website. To create a personal account, You will need to provide details such as Your real name, contact telephone number, postal address and a valid credit or debit card that We approve and accept. Ticketmaster Resale has absolute discretion to decide if you qualify (or continue to be qualified) as a Buyer. You are responsible for ensuring that the details You provide Us with remain valid and up to date. If the details You have provided to Us are no longer valid or up to date, Ticketmaster Resale may suspend Your account, or terminate the Agreement, in accordance with section 7 (Term, Termination and Suspension) of the Agreement.
2.2 Registered email address and password. To create and access Your personal account on the Website and use the services on the Website, You will need to provide a valid email address and password. You are solely responsible for maintaining the security of Your registered email address and password and for all activity that occurs on Your personal account under Your registered email address and password.
2.3 Reachable. You must be reachable by telephone between the hours of 8.00am and 10.00pm, Melbourne, Victoria time and respond to all Ticketmaster Resale enquiries in a prompt and timely manner. Certain enquiries and disputes will need to be resolved quickly, particularly in the case of upcoming events. If Ticketmaster Resale’s enquiry relates to an order for tickets placed by You, You must respond within 24 hours or by the specified deadline provided by Ticketmaster Resale via telephone voice message, email or post. You must handle the management of Your account in a reasonable and cooperative manner. If any abusive or threatening behaviour is reported, Ticketmaster Resale reserves the right to terminate the Agreement with You with immediate effect and without prior notice.
3. PURCHASING TICKETS
3.1 Selecting tickets. As a Buyer, You review the tickets listed on the Website and, when You find a ticket that You want at a price You want to pay, You click to buy that ticket, enter and confirm your credit or debit card information and confirm the purchase of the ticket. You should carefully read the full listing details for each ticket before clicking to buy the ticket, including (without limitation) section and row details and any restrictions or qualifications such as restricted view, family section, age restrictions, no alcohol permitted or concession. Please ensure that You have read the full listing details and are happy with Your ticket selection prior to confirming Your purchase as, once confirmed, You must proceed with the purchase of that ticket in accordance with the Agreement and You will likely be contractually bound, as between You and the Seller, to purchase that ticket.
As Ticketmaster Resale provides an open market place for the sale and purchase of tickets, there are many different types of Sellers listing tickets on the Website. For the avoidance of doubt, tickets are not sold by Ticketmaster Resale on the Website, they are sold by third parties. While We do not sell tickets on the Website, We may, on occasion, place tickets on the Website on behalf of (or as agent for) third parties such as Event Partners.
3.2 Pricing. Ticket market prices are volatile and can fluctuate and change at any time. Only when You have successfully completed an order for a ticket in accordance with section 3.4 (Payment) is that order concluded at the price displayed on the Website at the time You click to buy that ticket. Ticket prices are often set at a level which exceeds their “original face value". We make every reasonable effort to provide information on a ticket's “original face value" to you on the Website and to ensure that that information is accurate. The price displayed on the Website for a ticket is inclusive of all applicable fees and charges (including applicable GST) for that ticket but excludes any applicable delivery fee.
While We try to ensure the accuracy of all prices listed on the Website, sometimes technical errors may occur. In the event that a technical error has resulted in an error in the price of tickets You have ordered, We will inform You as soon as possible and, where practicable, give You the option of reconfirming Your order at the correct price (and credit or debit your credit or debit card as applicable) or cancelling Your order. If You choose the option of cancelling Your order after paying the incorrect price for a ticket, then You will receive a full refund from Us for that amount paid (including the cost of delivery). If we are unable to contact You, or it is not practicable to correct the price, You agree that we may cancel the order with our only liability to You being the full refund of the amount You paid for that ticket (including the cost of delivery).
If You believe that a technical error has occurred when placing Your order, please contact us as soon as possible and provide as much information or evidence of the technical error as possible (including screen shots wherever possible).
3.3 GST. Ticket prices displayed on the Website are inclusive of all applicable GST.
3.4 Payment. 100% full payment for a ticket, at the price displayed on the Website for that ticket at the time that You click to buy that ticket, must be received and verified by Us in order to ensure that an order for that ticket has been made at that price. The accepted forms of payment are those credit cards and debit cards specified on the Website from time to time. All payments will be taken in Australian dollars and Your credit or debit card will be expressed to be charged by "Ticketmaster Resale". The purchase of a ticket at the price displayed on the Website for that ticket is only confirmed once the order has been confirmed by You and payment has been received and verified by Us.
3.5 Confirmation. Once You place Your order and Your payment has been received and verified by Us, an order confirmation email will be sent to the email address You have registered to Your personal account. If You do not receive a confirmation email, do not assume that Your order has not gone through; instead please phone us on 1300 651 607 to request another confirmation email. We are not responsible for any internet connection errors experienced while placing an order for tickets. If You have not received an order confirmation email, it is Your responsibility to contact Us to verify Your order before making another order.
Your order confirmation email will include details of the tickets that you have purchased, together with your name and postal address. You must check these details carefully and let Us know of any errors as soon as possible (and in any event within 24 hours after the time the order confirmation email is sent). Please note that failure to provide correct name, email address or postal address details at the time of account creation (or to keep those details up to date after account creation) could lead to failed delivery of ordered tickets. Any failure by You to provide correct name, email address or postal address details (or to keep these details up to date) is at Your own risk and Ticketmaster Resale takes no responsibility, and is not liable, for any failure to receive ordered tickets or to gain access to events to the extent arising from Your failure to provide Ticketmaster Resale with Your current name, email address or postal address details.
While We try to ensure the accuracy of orders, sometimes technical errors may occur. In the event that a technical error has resulted in an incorrect order, We will inform You as soon as possible and, where practicable, give You the option of reconfirming Your order as corrected (and credit or debit your credit or debit card, if applicable) or cancelling Your order. If You choose the option of cancelling Your order after paying for tickets, then You will receive a full refund from Us for the amount paid (including the cost of delivery). If we are unable to contact You or it is not practicable to correct the order, You agree that we may cancel the order with our only liability to You being the full refund of the amount You paid for the tickets (including the cost of delivery).
To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), despite the fact that You have been advised by Ticketmaster Resale, via an order confirmation email or otherwise, that Your order has been confirmed or otherwise processed or accepted, Ticketmaster Resale reserves the right to suspend an order pending additional fraud checks and to terminate any order that has been fraudulently made. Ticketmaster Resale has no liability to You in connection with the termination of any order that You have fraudulently made.
3.6 Changes / Cancellation of Events. IMPORTANT NOTE: events are sometimes rescheduled or cancelled completely. While event dates and times are normally printed on the tickets and are not usually subject to change, it is important that you monitor local media for any information relating to the rescheduling or cancellation of relevant events.
If an event for which You have purchased a ticket via the Website is cancelled and not re-scheduled, then You agree to follow all reasonable directions of Ticketmaster Resale in respect of Your ticket for that event (including, without limitation, returning that ticket to Ticketmaster Resale to facilitate the relevant Seller obtaining a refund from the promoter or producer of the applicable event). Subject to You complying with all reasonable directions of Ticketmaster Resale in respect of a ticket for a cancelled event that is not rescheduled, Ticketmaster Resale will provide You with a full refund of the amount that You paid for that ticket, excluding any amount paid in respect of delivery fees.
To the fullest extent permitted by law (and subject to Your Australian Consumer Law rights and any rights You have in respect of events that are cancelled and not rescheduled), all ticket purchases on the Website are final and no refund or exchanges will be given by Ticketmaster Resale. Please be aware that on occasion an event promoter or producer may at their discretion or owing to production changes opt to make changes to an event and/or tickets (including, without limitation, by providing alternative seats instead of the original seats). If an event promoter or producer reschedules an event, the applicable ticket will often be valid for the new date and time. Unless otherwise required by law, Ticketmaster Resale has no liability to You in respect of changes to an event and/or tickets or rescheduled events, including (without limitation) any liability to refund the price of the applicable ticket (or any delivery fees). In the event that Ticketmaster Resale does contact You in respect of changes to an event and/or tickets or rescheduled events, then You must cooperate with Ticketmaster Resale and (through Ticketmaster Resale) the Seller in respect of those changes or that rescheduling.
Nothing in this section 3.6 is intended to limit, or limits, any rights You may have under the Competition and Consumer Act 2010 (including under the Australian Consumer Law set out in Schedule 2 of that Act) or any other applicable consumer law.
3.7 Queries and Ticket Validity. All queries relating to tickets purchased via the Website must be directed to Ticketmaster Resale at resale.service@ticketmaster.com.au rather than to the relevant venue, promoter or producer. Subject to the applicable ticket, promoter/producer and venue terms and conditions, if a ticket You purchase via the Website does not give You entrance to the applicable event, We will refund 100% of the purchase price You paid for that ticket as part of our Ticketmaster Guarantee. However, if You breach the applicable ticket, promoter/producer or venue terms and conditions (or if You breach the Agreement including, without limitation, by directing any queries relating to the tickets to the venue or promoter/producer rather than Ticketmaster Resale) and as a result are not able to gain entry to the event, then You are not entitled to receive any refund under the Ticketmaster Guarantee.
3.8 Substitutions. Please be aware that a Seller might substitute a ticket that You have ordered via the Website with a different ticket (for example, a ticket that has equal or better seat locations). If You accept tickets delivered to You in substitution for the original tickets that you ordered via the Website, then, irrespective of the differences between the tickets, you irrevocably waive Your right to exercise the Ticketmaster Guarantee in relation to such tickets.
3.9 Seating. Unless indicated otherwise at the time of purchase, all tickets purchased in a single order will be seated together.
4. DELIVERY
4.1 Delivery of Ticketmaster Tickets. (For the definition of a Ticketmaster Ticket, see section 1.3 (About Us).) If You order a Ticketmaster Ticket that is listed for sale on the Website, then the Seller’s ticket will be automatically cancelled by the Ticketmaster ticketing system on the electronic authentication of Your order and payment and Ticketmaster Resale will reissue a new ticket to You. Ticketmaster Resale will email the new ticket to the email address that You have registered to Your personal account. To the fullest extent permitted by law, Ticketmaster Resale’s liability to You in connection with the cancellation of any Ticketmaster Ticket and the reissue of a new ticket is limited to the amount paid by You for that new Ticket (including the cost of delivery).
If You have not received the new ticket issued in replacement of a Ticketmaster Ticket within 24 hours after placing the order for that ticket, You should immediately contact Ticketmaster Resale on 1300 651 607. Please note that, before ordering any tickets on the Website You should ensure that the email address You have registered to Your personal account is up to date. Any failure by You to provide a valid email address at the time of account creation (or to keep Your registered email address details up to date) is at Your own risk and Ticketmaster Resale takes no responsibility, and is not liable, for any failure to receive ordered tickets or to gain access to events to the extent arising from Your failure to provide Ticketmaster Resale with Your valid email address.
The provisions of sections 4.2 to 4.4 below do not apply in respect of Ticketmaster Tickets.
4.2 Delivery Method for tickets other than Ticketmaster Tickets. All tickets ordered via the Website (other than Ticketmaster Tickets) will be dispatched by the Seller using the carrier nominated by Ticketmaster Resale from time to time. Deliveries will need to be signed for and accepted in person. It is Your responsibility to provide an appropriate delivery point and to make yourself available to sign for and accept delivery. Ticketmaster Resale will not be liable for refused or failed delivery to the extent arising from Your failure to provide complete delivery information to Us (including, without limitation, Your real name and correct, up to date, postal address) or for any unclaimed post or return deliveries. If for any reason Your tickets are returned to Us or We are notified that they could not be delivered, We will attempt to contact You and arrange for another delivery via Ticketmaster Resale’s nominated carrier. Please be aware that in these circumstances, You will be liable for the full cost of the redelivery. To the fullest extent permitted by law, Ticketmaster Resale takes no responsibility, and is not liable, for Your failure to receive ordered tickets or to gain access to events to the extent arising from Your failure to provide Ticketmaster Resale with complete delivery information or to be available for, or to otherwise sign for and accept, delivery.
In the event that any ticket ordered by You via the Website is lost, delayed or damaged due to the fault of Ticketmaster Resale’s nominated carrier such that You are unable to use that ticket to attend the relevant event, then Ticketmaster Resale will refund You 100% of the amount You paid for that ticket (including the cost of delivery). If Your tickets have not arrived five working days after You are sent the order confirmation email for those tickets, You must immediately notify Ticketmaster Resale on 1300 651 607 so that we can initiate an investigation. If Ticketmaster Resale notifies You that We are investigating the delivery of any ticket that has been ordered by You, you must fully cooperate with Us in respect of that investigation. Despite any other provision to the contrary in the Agreement, Ticketmaster’s liability to provide a refund to You in respect of any failed delivery of tickets is limited to the extent that Your failure to do something required by the Agreement has contributed to (or limited the rectification of) that failed delivery.
4.3 Local address. Tickets ordered via the Website are only able to be delivered to an Australian postal address.
4.4 Failed delivery. If for any reason Your tickets are returned to Us or could not be delivered and We are unable to contact You to arrange for redelivery or You refuse delivery of Your tickets, then You agree that We may place the tickets back for sale on the Website on consignment and act as your agent to attempt to recover some or all of Your costs. You have the right to set the asking price for Your tickets, however, if no communication can be made with You, we will price them reasonably appropriately in attempt to recover as much of Your money as possible. In some cases this could be substantially less than what You originally paid for the tickets and we cannot guarantee a sale completes at all. If Your tickets do sell, We will first deduct an administration fee of $50 from the sale proceeds, then pay You any available balance of those proceeds up to the amount that You paid for those tickets (including the cost of delivery) and You agree that We may then retain any remaining portion of those proceeds. Ticketmaster Resale has no obligation to place Your tickets on consignment and no obligation to You for the payment of any amount in respect of those tickets other than as expressly set out in this clause 4.4 (Failed delivery) or as otherwise required in accordance with law (including, without limitation, Australian Consumer Law).
4.5 Tickets held back by the promoter or producer. Sometimes a promoter or producer of an event may hold back the distribution of tickets until closer to the time of the event. If a promoter or producer is holding back a ticket that You have purchased from the Website, that ticket will be delivered to You as soon as possible once the promoter or producer releases that ticket.
4.6 Accuracy. Once tickets have been delivered to You, it is Your responsibility to immediately check the tickets for accuracy. If there are any discrepancies between a ticket that You receive and the ticket that You ordered via the Website, You must immediately notify Us and must comply with any reasonable direction given by Us in respect of the incorrect ticket (including, without limitation, the return of the incorrect ticket to Us at Ticketmaster Resale’s cost). If You receive an incorrect ticket, We will endeavour to source a replacement ticket for You that is (in Ticketmaster Resale’s reasonable opinion) equal to or better than the incorrect ticket (“Replacement Ticket”). You acknowledge that We may not be able to, or it may not be practicable for Us to, purchase a Replacement Ticket and, in this case, our liability to You will be limited to the full refund to You of the amount that You paid for that ticket (including the cost of delivery). If You do not return incorrect tickets to Us on request and/or subsequently use such tickets, then You will not in any circumstances be entitled to a refund for those tickets and irrevocably waive Your right to exercise the Ticketmaster Guarantee in relation to such tickets.
If You report a discrepancy between a ticket that You receive and the ticket that You ordered while at the relevant event or after the event is held, you will be deemed to have accepted the delivered tickets as valid and waive Your right to the Ticketmaster Guarantee.
4.7 Lost, stolen, damaged or destroyed tickets. Please treat all tickets that You receive with extreme care as Ticketmaster Resale does not issue an exchange or refund for a lost, stolen, damaged or destroyed ticket unless, in the case of Ticketmaster Tickets only, You give Ticketmaster Resale a reasonable amount of notice ahead of the relevant event that the ticket has been lost, stolen, damaged or destroyed, in which case Ticketmaster Resale may issue a replacement ticket to You for a reasonable administration fee.
5. LIABILITY AND INDEMNIFICATION
Nothing in this section 5 is in anyway intended to exclude or limit, or excludes or limits, any liability that the Agreement expressly provides Ticketmaster Resale has to You or any liability that cannot otherwise be excluded or limited under any law (including, without limitation, any liability that may not be excluded or limited under the provisions of the Competition and Consumer Act 2010 and the Australian Consumer Law set out in Schedule 2 of that Act).
5.1 Release. Ticketmaster Resale, through the Website, facilitates an open market place for the sale and purchase of tickets. Ticketmaster Resale is not a party to any contract that may arise outside of the Agreement between You and any Seller when tickets are sold and purchased via the Website. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), Ticketmaster Resale has no liability to You in connection with any contract between You and a Seller and You release Us from any liability We may have to You in respect of any expenses, costs, losses, damages, claims or demands that You may incur or suffer in connection with any contract between You and a Seller.
5.2 Liability. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), Ticketmaster Resale shall in no circumstances be liable to You for any indirect or consequential losses or any loss of enjoyment or opportunity arising out of Your use of the Website, including (without limitation) from Your purchase of tickets or any failure to purchase tickets. In respect of each order for tickets that You make via the Website, Ticketmaster Resale’s liability to You whether in contract, tort or otherwise shall be limited in aggregate to the total amount paid by You in relation to such order (including the cost of delivery).
5.3 Event Loss. For the avoidance of doubt, Ticketmaster Resale does not stage, and is not responsible for the staging of, the events for which You may purchase tickets on the Website. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), We disclaim all liability connected with the staging of events for which You have purchased tickets from the Website and for any death or personal injury suffered by You, or any person to whom You provide a ticket purchased from the Website, arising out of attendance at, or travel to, any event unless caused by our negligence. Neither shall We be liable for any loss or damage sustained to Your property or belongings (or those of any person to whom You provide a ticket purchased from the Website).
5.4 Force Majeure. To the fullest extent permitted by law (including, without limitation, the Australian Consumer Law), We will not be liable for any loss or damage suffered by You arising out of circumstances that are beyond our control including but not limited to any act of God, natural disaster, act of terrorism or other force majeure event.
6. WARRANTIES
6.1 True information. You represent and warrant to Us that the information You submit to Us in creating and updating Your personal account and in making an order for tickets on the Website is true, accurate and complete. You agree not to use false names or addresses, or any other false information, in using the Website.
6.2 Legal Compliance. You represent and warrant to Us that, during any interaction with the Website, you will comply with all applicable local, state, national and international laws. You also represent and warrant to Us that you are 18 or over and therefore able to enter into legally binding contracts.
7 TERM, TERMINATION AND SUSPENSION
7.1 Term. Subject to section 7.2 (Termination), the Agreement commences on the date You first create a personal account on the Website and continues in force until the date that falls 30 days after either party receives notice in writing from the other party terminating the Agreement.
7.2 Termination. Either party may terminate the Agreement immediately by giving written notice to the other party if the other party (i) commits a material or persistent breach of its obligations under the Agreement and fails to remedy that breach within 7 days after being given written notice specifying the breach and requiring it to be remedied; or (ii) is unable to pay its debts, becomes insolvent or any action is successfully taken to wind it up or to appoint a liquidator, administrator or controller (as defined in the Corporations Act 2001 (Cth)) or it enters into an arrangement, compromise or composition with or assignment for the benefit of its creditors or any of them or, in the case of an individual, is declared bankrupt.
Ticketmaster Resale may terminate the Agreement immediately if, in its reasonable opinion, You are involved or likely to be involved in any illegal activity.
7.3 Suspension. Without limitation to its other rights under the Agreement or otherwise at law, Ticketmaster Resale may suspend Your account for one calendar month or such longer term as determined by Ticketmaster Resale in its sole discretion, if You breach any of the terms of the Agreement.
7.4 Consequences of termination. Termination of the Agreement does not affect the rights or liabilities of either party accrued prior to and including the date of termination and/or any terms intended expressly or by implication to survive termination.
8. MISCELLANEOUS
(A) The Agreement (and all documents incorporated by reference) constitutes the entire agreement between the parties pertaining to its subject matter and supersedes all prior agreements and understandings between the parties with respect to its subject matter, whether written or oral. No amendment, modification or supplement of any provision of the Agreement will be valid or effective unless made in accordance with the express terms of the Agreement. If any provision of the Agreement is held to be invalid or unenforceable under any circumstances, its application in any other circumstances and the remaining provisions of the Agreement will not be affected.
(B) No failure or delay by either party in exercising any right under the Agreement should be deemed to be a waiver of that right and no waiver of a breach of a provision of the Agreement shall be deemed to be a waiver of any subsequent breach.
(C) You may not assign or transfer the Agreement, or any rights or obligations under the Agreement, without the prior written consent of Ticketmaster Resale, which We can refuse in our absolute discretion.
(D) Nothing in the Agreement is intended to confer benefits, rights or remedies on any person or entity other than the parties to the Agreement and their successors and permitted assigns.
(E) The subject heading at the beginning of each paragraph of the Agreement is for reference purposes only and in no way defines, limits, construes or describes the scope or extent of such paragraph.
(F) Any notices required or permitted to be given under the Agreement must be in writing and sent by registered post addressed (i) if to Ticketmaster Resale, to Level 5, 364 Lonsdale Street, Melbourne Victoria 3000 and (ii) if to You, to the postal address provided by You in creating Your personal account, as updated by You from time to time.
(G) The Agreement shall be governed by and construed in accordance with the law of Victoria, Australia and both parties agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.

If a problem arises you won't have to deal direct with the seller. Ticketmaster Resale will step in on your behalf to source replacement tickets that are comparable or better – at no additional cost to you.
In the unlikely event we can't get the seller to deliver your original tickets or we can't source replacements on your behalf, we promise that you will get 100% of your money refunded.

Contact us at any time prior to the event, although please note if it's within 5 days of the event taking place it may be more difficult to source alternative tickets and your options may be limited to receiving a refund. If you are contacting us after the event has taken place because you experienced problems with your tickets, you must do so within 5 days of the event to make sure we can take the issue up with the seller in good time. However, please note that if you received incorrect tickets but didn't contact us before the event took place you won't be able to claim under the Ticketmaster Guarantee. You should check your tickets carefully when they arrive to make sure they match the ones you purchased.
This commitment is given to you by Ticketmaster Resale in addition to your rights and remedies as a consumer under applicable law (including the Australian Consumer Law) in respect of goods and services supplied by Ticketmaster Resale or third parties . Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be acceptable quality and the failure does not amount to a major failure.
